We are very serious here at TreasureUSA in presenting you a pleasant and safe venue for buying and selling items online. We will not tolerate any sort of fraud, scamming, or illegal activity of any sort on this web site. Persons engaging in such will be terminated from using TreasureUSA and may be subject to both criminal and civil prosecution. Below are the legalities we are required to state and which you agree to abide by when registering to be a user on TreasureUSA. We may amend this Agreement at any time by posting the amended terms on our website.

Article 1. Eligibility of membership - This trading site is only available to people who are legally able to form binding contracts with you and the seller/buyer of a item listed for sale. People who are of under age of 18 are not eligible for membership due to security precautions that can result as of those members. If you do not meet these requirements, you are not eligible to use TreasureUSA open forum trading services.

Article 2. TreasureUSA is only providing trading services - We only provide services to people interested in selling and buying merchandise via internet trading. We do not have control over the items that are posted in the trading site, and cannot guarantee the authenticity and quality of a said product. We are not responsible for the actions the sellers takes, before, during, and after the trade, typographical errors, misprints or other typos, loss of merchandise/money, damage or failure of equipment, due to your visit to this trading site. Use of this site is at your own risk, and content is presented 'As-Is', without a warranty or condition. TreasureUSA is not liable for any damages resulting in the buying and selling of items, or your visit to the site. TreasureUSA is not responsible; nor liable for any damages caused or alleged to be caused directly, indirectly, incidentally, or consequentially by anything on or related to this trading site.

Article 3. Conditions of Service - We at TreasureUSA cannot and will not get involved in disputes between users. In the case that you have such a dispute, by registering on this site, you are releasing TreasureUSA and its agents, employees, and assignees, and any affiliated companies or individuals from any claims, suspected and unsuspected, whether disclosed or undisclosed, arising out of, or in any way connected to, any disputes. We suggest and expect that users will employ common good business practices and personal courtesy to avoid disputes. If another user has a complaint with you, please establish a polite dialog with him or her to resolve the dispute to mutual satisfaction. Above all, when buying something from someone--whether on the internet or anywhere else--your best protection is to be an informed buyer. In Latin: Caveat Emptor! The age-old warning of Buyer Beware!

Article 4. Making Offers and Selling - As a user, you may make offers and/or sell merchandise on TreasureUSA. As a potential buyer, you know that making an offer is a binding contract with you and the seller, and the offer cannot be retracted unless due to fault by the seller of typographical error, or other error, due to human error on the seller's part. Once you make an offer, and if the seller accepts your offer, you will be obligated to buy the item at the said price you indicated as your offer. Making a winning offer on this website, and then not paying for the item is illegal in most states, and prosecution can result to you.

As a seller, the item that you place up for sale must be real. Pre-sales are accepted. Once an offer has been placed for your item, you are being placed in a binding contract with the potential buyer of the item, if that offer is deemed acceptable by seller. Once trading is over, the seller is obligated to sell to the item to said potential buyer. If, you do not accept any offers made by potential buyers, you are not obligated in any way to sell this item at all. As a seller, you are not in any way to make offers on your own items. If reported, your listing will be deleted.

The use of a trademark or service mark in your listings should be capitalized and indication as such. Since we have no control over posting, the use of any trademark or service mark in this auction, proper or improper, cannot and should not be construed as affecting the validity of that trademark or service mark.

Article 5. Posting Items - As a user, you are welcome to post items up for sale on TreasureUSA. We do have restrictions on what items you may sell, and what you may not sell. You may not sell illegal merchandise, including pirated software and music, firearms, adult videos, or anything that is affiliated with pornography, etc. Items that are up for sale are subject to review by the staff of TreasureUSA, and may be removed without prior notice, if in violation with this User Agreement. Any one attempting to post illegal merchandise, including pirated software and music, firearms, adult videos, any item in any way infringing on a legitimate copyright, or anything that is affiliated with pornography, etc. Links within your listings to sites violating the above are also forbidden.

Article 6. Suspension or Termination - Here are some things that will get you suspended, terminated, and/or prosecuted:

Giving us false information when registering, such as a false name or fraudulent contact information.

Registering more than one username for yourself in order to artificially raise the selling price of your own items posted for sale, or to conduct any other fraudulent or illegitimate activity.

We are against spam and we respect the privacy of our users. We do not use cookies or any other method to gather information about you other than legitimate registration. We use your e-mail address for contacting buyers or sellers only. Any use of this private information by anyone else is strictly prohibited and we WILL take action.

Don't bid unless you intend to buy. Don't offer an item unless you intend to follow through with the winning bidder. For a potential buyer not to honor an offer they submitted is illegal in many states.

Don't list items in inappropriate categories just to get additional exposure or for any other reason. Violators of this policy are subject to suspension or termination. If you have something that does not fit any of our categories, please e-mail us and request that category be added to the trading community.

We reserve the right to remove anyone from TreasureUSA at any time for any reason we deem sufficient and without explanation required. We will tolerate no violations of law or regulations by any actions, especially those that are libelous, threatening, harassing, or obscene.

Any one attempting to compromise the safety, security, data integrity, service, or any other fact of TreasureUSA will be suspended or terminated and WILL face possible legal action. We've worked hard to present this trading opportunity for you and will not allow one or two to ruin it for the many.

Article 7. Charges - Making offers to buy an item, and registering with TreasureUSA is free. Our Fees for listing items for sale, final value fees, and fees for other TreasureUSA services may change from time to time. When you list an item with TreasureUSA you have an opportunity to review and accept the fees charged to you for those listing services. You are responsible for paying all fees associated with using our service and all applicable taxes if they apply.

Article 8. Privacy - We gather your information so that other people will have it on hand when they win your item, or you win their item. Personal information is not sold, rented, without your permission. Personal information sent to a user regarding a product bought or sold on TreasureUSA is not to be used for any other purpose, except for communication with the trading item. When you provide your personal information to TreasureUSA (such as name, address, phone number, company name, email address, credit card number, etc.) we will not give or sell your individual information to any outside company for its use in marketing or solicitation. We will maintain the confidentiality of your personal information and it will be used only to support your customer relationship with TreasureUSA. Additionally, internal practices help protect your privacy by limiting employee access to and use of customer data. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

Article 9. Warranty - TreasureUSA provides this website in an 'as-is' condition, without a warranty or condition. TreasureUSA is not liable for any damages resulting in an auction, or your visit to the site. We cannot, and will not, be held responsible for any interruption in service, caused by any means, therefore we cannot guarantee continual, uninterrupted service as our website could be interfered with by means out of our control.
